Know Your Rights: Free Speech and Social Media

Educators and public employees are facing increased scrutiny for what they say online and in public. These resources will help you understand your rights, protect yourself on social media, and advocate for students and public education with confidence.
Published: September 30, 2025

In the aftermath of recent and heinous acts of political violence, which we unequivocally condemn, educators and public employees are under attack, facing heightened scrutiny for what they say – particularly on social media. Violence has no place in our democracy, and we stand firm in our commitment to free expression and advocacy.

Across the country, efforts by some groups and individuals to call out, repress, or punish educators and other public employees have led to complaints, disciplinary actions, and even public targeting for speech made outside of work.

This climate has raised serious concerns about privacy, professional repercussions, and the ability to advocate for students and public education without fear. In some cases, officials have even suggested consequences that extend beyond the workplace, creating additional risks for those who speak out.

To help you navigate these challenges, we’ve provided three resources. The first highlights your rights when advocating for students and public education, the second offers important guidance on protecting yourself and exercising caution when using social media. The third is a short, informative video from our colleagues at NYSUT, Know Your Rights: Free Speech.

We encourage you to review all three so you can feel confident, knowledgeable, and supported in your advocacy.  If you have specific concerns, please reach out to your Local President, who can connect you with your UniServ Director
